The United States shall guarantee to every State in this Union a Republican Form of Government and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence. [emphasis added]
Clearly, the United States is currently subject to an invasion by foreigners at the southern border.
The federal government, as defined in Article IV, Sec. 4 of the United States Constitution, is abdicating its responsibility under that article by refusing to enforce federal immigration law.
In essence, the Biden administration is engaging in criminal activity, a fact that isn’t lost on a former Kansas secretary of state.
Kris Kobach is representing at least two law enforcement agencies dealing with the incursion at the southern border, officers affiliated with Immigration and Customs Enforcement (ICE) as well as a group of Texas sheriffs who have filed a lawsuit against the Biden administration over (lack of) border law enforcement, according to Conservative Playbook.
During a Monday podcast, Kobach said the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (IIRIRA) removed all discretion with regard to removing illegal aliens from the country away from the executive branch.
Under the law, the requirement is simply to “detain and remove illegal immigrants.” Period.
“[T]he Biden administration’s just ignoring the law and actually ordering ICE officers and Border Patrol officers to disregard the law, to violate the law,” Kobach said. “And that has a really deleterious effect on Texas counties and sheriffs because they are no longer taking custody of and deporting dangerous alien criminals.”
Kobach noted many of the illegal aliens have “very long criminal records, and “have committed really atrocious crimes,” including sex crimes against minors, assaults on officers and weapons violations.
